THIS PRIVACY POLICY (“POLICY”) PROVIDES INFORMATION ABOUT HOW DENTPAL LLC (“DENTPAL,” "WE," OR "US") MAY COLLECT, USE, DISCLOSE, TRANSFER AND SHARE PERSONAL INFORMATION ABOUT CUSTOMERS, VENDORS, THEIR AUTHORIZED USERS, AND SITE VISITORS (COLLECTIVELY REFERRED TO HEREIN AS “YOU”). THIS POLICY ALSO PROVIDES ADDITIONAL INFORMATION REQUIRED UNDER CALIFORNIA LAW ABOUT OUR COLLECTION, USE AND DISCLOSURE OF THE INFORMATION OF CALIFORNIA RESIDENTS FROM BOTH ONLINE AND OFFLINE SOURCES, ALONG WITH OTHER REQUIRED INFORMATION SUCH AS RIGHTS THAT MAY BE AVAILABLE TO CALIFORNIA RESIDENTS. DENTPAL RESERVES THE RIGHT TO AMEND, ALTER, OR MODIFY THIS POLICY AT ANY TIME. BY USING OR ACCESSING DENTPAL’S SERVICES, PORTALS, OR SITES, YOU ACKNOWLEDGE THAT YOU ACCEPT THE PRACTICES AND POLICIES OUTLINED IN THIS POLICY, AND YOU HEREBY CONSENT TO OUR COLLECTION, USE, DISCLOSURE, TRANSFER AND SHARING OF YOUR INFORMATION IN THE MANNER DESCRIBED HEREIN. IF YOU DO NOT AGREE WITH THIS POLICY, DO NOT USE THE SITES, SERVICES OR PORTALS OR TRANSACT BUSINESS WITH DENTPAL. THIS POLICY MAY CHANGE FROM TIME TO TIME. YOUR CONTINUED USE OF THE SERVICES, PORTALS, OR SITES AFTER DENTPAL MAKES CHANGES IS DEEMED TO BE ACCEPTANCE OF THOSE CHANGES, SO PLEASE CHECK THE POLICY PERIODICALLY FOR UPDATES. IF YOU ARE REGISTERING AN ACCOUNT OR USING THE SERVICES ON BEHALF OF AN INDIVIDUAL OR ENTITY OTHER THAN YOURSELF, YOU REPRESENT THAT YOU ARE AUTHORIZED BY SUCH INDIVIDUAL OR ENTITY TO AGREE TO THIS POLICY ON SUCH INDIVIDUAL'S OR ENTITY'S BEHALF.

  1. Definitions.

    1. Authorized User” means employees, consultants, contractors, and agents (i) who are authorized by Customer or Vendor, as applicable, to access and use the Services under the rights granted to such Customer or Vendor.

    2. Customer” means customers who have accepted DentPal’s Dental Practice Terms of Service or who otherwise have an agreement with DentPal to access and use the Services.

    3. Customer Agreement” means the Dental Practice Terms of Service or other agreement between DentPal and Customer.

    4. Customer Portal” means a portal accessed by Customers in accessing or using the Services.

    5. Patient” means patients of Customers.

    6. “Personal Information” is information that identifies an individual or relates to an identifiable individual or household. The types of Personal Information collected may include your name, address, IP address, mailing address, contact information, email address, phone number, mobile network, hardware, operating system and application (including versions and updates), pages you visit, and other information you may produce to us, and the uses thereof depend on the purposes for which we collect the Personal Information (e.g., whether you are a visitor to our Sites, a user of our Portals, or a user of our Services). Both federal and state law in the United States define Personal Information. This Policy is intended to include the most expansive definition that applies to you. As used in this Policy, Personal Information does not include Protected Health Information.

    7. Portal” means collectively Customer Portals.

    8. "Protected Health Information" or "PHI" is individually identifiable health information that is protected by HIPAA.

    9. Service Agreements” means collectively the Customer Agreements and Vendor Agreements.

    10. Services” means the services provided by DentPal under this Agreement pursuant to a Customer Agreement or Vendor Agreement.

    11. Sites” means DentPal websites.

    12. Site Visitors” means visitors to the Sites.

    13. "Usage Data" is information that we automatically collect about your use of the Sites, Portals and Services and includes the sort that Web browsers and servers typically make available, through Web server logs, Web beacons, cookies and other similar tracking technologies, about the devices you use to access our Sites, Portals and Services, as well as information on how you interact with our Sites, Portals and Services. We may collect log information including Usage Data for internal uses or uses by our Vendors on our behalf, such as ensuring the security and integrity of our Services. Usage Data may include the IP address of a device or internet service used to connect your device to the Internet and may provide information about your location; computer and connection information such as your browser type and version; operating system and platform; confirmation when you open e-mail that we send you; purchase history; and the URLs which lead you to and around the Sites, Portals and Services including the date and time of access. Usage Data may overlap with location information. Usage Data generally does not directly identify an individual, but may constitute Personal Information in some instances.

    14. Vendor” means third-party vendors that DentPal engages from time to time that are related to the provision and support of the Sites, Portals or Services.

    15. Vendor Agreement” means the agreement between DentPal and Vendor.

  2. Scope and Purpose.

    1. This Policy provides information about how DentPal may collect, use, disclose, transfer and share information about you that we obtain through the Sites, Portals, Services and any other services and applications that link to this Policy, as well as when you participate in our email or text communications. You can opt out of providing information by not entering it when asked and, if such information is required in order to allow us to respond to your inquiry, you will receive a notice advising you of this. If you do not provide us with some or all of the requested information, we may not be able to provide Services to you.

    2. This Policy also applies to any information we collect offline, such as when you attend DentPal events, or interact with our representatives at other events, or in other contexts in which we make this Policy available to you.

    3. This Policy does not apply to DentPal product offerings that have their own privacy policies, or to websites of third-parties to which we provide links. We do not control and are not responsible for the privacy practices of the websites of other entities and we urge you to review any applicable third-party privacy policies for yourself.

    4. Our processing of data on behalf of our Customers is governed by the Customer Agreements, which may include Business Associate Agreements as applicable and required under the Health Insurance Portability and Accountability Act (“HIPAA”).

  3. What Does DentPal Do?

    1. DentPal is a provider of network-enabled services for dental practices nationwide, headquartered in the United States. We offer cloud-based solutions in healthcare to deliver providers with multiple potential solutions including electronic health records and patient engagement tools.   4. What Personal Information Do We Collect?

    1. The types of Personal Information that we collect depend on your interactions with us. We collect Personal Information that generally falls into the following categories:

      1. Identifiers, such as your name, email address, or IP address.

      2. Information contained in our Customer records, such as postal address or telephone number.

      3. Commercial information, such as information regarding products or services you purchased.

      4. Internet or other electronic network activity information, such as how you interact with our Sites, Portals and Services.

      5. Professional or employment information, such as you job title or employer.

      6. Geolocation data, such as your general location information (e.g., city/state) which may be collected or derived from your IP address. In addition, some of our services may request your precise location information via GPS-based functionality to allow certain features to work. We will ask your permission before we collect or use precise location information, in accordance with any applicable legal requirements to the extent precise geolocation information is considered “sensitive” information under applicable law.

  5. How Do We Collect Your Information? We may collect your information in the following ways:

    1. We collect information you provide directly to us, such as when you voluntarily enter information into fields on our Sites, Portals or through our Services, sign up for or request certain services or information, agree to participate in our surveys, or call our customer service. Depending on how you interact with us, we may ask for your name, practice/organization name, address, email address, mailing address, telephone number, and type of user.

    2. If you have an account with us, we may also collect your username or other login information (e.g., Practice ID or user ID) you use to log into or access your account.

    3. If you visit our offices or attend in-person DentPal events, we may collect information to protect the health and safety of our personnel, clients, guests, and the general public, such as health and travel information or any other information you provide to us.

    4. When you communicate with DentPal about our Sites or Services whether by letter, e-mail, online chat window, or telephone.

    5. When you interact with us on social media and provide us Personal Information.

    6. When you access our Sites or Services, we may collect Usage Data and other information, subject to the settings of your device that you use to access the Sites, Portals and Services, about your visit and your device using automatic data collection technologies as described in the “Cookies and Automated Data Collection Technologies” section below. This information may include IP address, geolocation information, browser type and version, device type, mobile device identifiers, and information reflecting how you searched, browsed, and were directed to the Sites or Services, including mouse movement, click, touch, scroll, and keystroke activity.

    7. We may also collect information from other sources, such as the Internet and other publicly-available sources and databases, data aggregators, marketing companies, lead generation companies, social networks, and business partners that offer co-branded services or help us provide, sell or distribute our Services and other third parties, including sources from which you authorize us to obtain Personal Information about you on your behalf. If you authorize us to collect information from a third party, or if you authorize a third party to send us information, and you later decide that you no longer want us to obtain that information, you may need to contact the third-party source directly and request that they stop transmitting information to us.

  6. Protected Health Information; DentPal as a Business Associate.

    1. Certain Services we provide to our Customers, such as the Portals, as well as certain support operations, involve access to, and the processing of, PHI. This PHI is provided to us pursuant to a Customer Agreement that also governs our use of PHI of Patients provided by our Customers.

      1. This Policy supplements the Customer Agreement. DentPal only uses such PHI as a "business associate" of its Customers, who are "covered entities," in accordance with any instructions or restrictions provided to DentPal by the Customer and in full compliance with the applicable provisions of HIPAA.

      2. Our Sites are generally not intended to collect or retain any PHI. Thus, sections of this Policy that discuss Personal Information collection on our Sites do not apply to PHI, and we do not request, obtain, use or disclose any PHI through our Sites such as www.dentpal.com .

  7. How Do We Use Your Information? We use your information:

    1. In ways that you would expect us to based on why we collected it. For example, if you contact us with a request for information about our products or Services, we will use your information to respond to your request.

    2. To provide, enhance and improve our Sites, Portals and Services to Authorized Users, Site Visitors or other users. If you are a Patient of a Customer, we use your information when providing the Services to the Customer.

    3. To optimize our Sites, Portals and Services functionality and identify our visitors’ and users’ areas of interest. For example, when you participate in our surveys, screeners, and/or information gathering sessions, or otherwise provide feedback, we may use that feedback to develop new products and services.

    4. To conduct internal analytics for the purpose of development and improvement of our Sites, Portals and Services or to develop new services.

    5. To identify and authenticate you, such as to determine and validate whether you are an existing user of our Services or products or a prospective client.

    6. To personalize and improve your visit and experience to our Sites, Portals or with our Services.

    7. To send marketing communications or to help target specific offers to Authorized Users and other users. You may opt-out of receiving marketing communications from us by following the instructions included in such a communication or by contacting us as provided in the Contact Information Section 18. If you opt out, we may still send you non-marketing communications, such as those about your account or our ongoing business relationship.

    8. To enable cross-device/cross-context tracking for an account you may have with us. For example, you might use multiple browsers on a single device, or use various devices (such as desktops, smartphones, and tablets), which can result in your having multiple accounts or profiles across various contexts and devices. Cross-device/cross-context technology may be used to connect these various accounts or profiles and the corresponding data from the different contexts and devices so you can more easily use your account(s).

    9. To communicate with you, such as send you emails, solicitations, invitations, newsletters, awareness campaigns, and announcements; and respond to service requests, questions and concerns, and administer accounts.

    10. To administer fees and provide users with invoices or resolve billing issues. We may use your information to verify your identity in order to process your payments.

    11. To maintain the safety, security, and integrity of our Sites, Portals and Services, and for our own internal legal compliance purposes.

    12. To protect the health and safety of our personnel, clients, guests, and the general public.

    13. To comply with law. We may disclose your information to comply with any applicable laws and/or regulations, such as to comply with valid legal processes such as a search warrant, subpoena, or order from a court or tribunal of competent jurisdiction.

    14. For other purposes explained at the time of collection, or for other business purposes consistent with the context of the collection of your information.

    We may use information that does not identify you and could not reasonably be used to identify you (including information that has been aggregated, anonymized, or de-identified) for any purpose except as prohibited by applicable law.

  8. How Do We Disclose or Share Your Information?

    1. We may disclose your Personal Information for the following reasons:

      1. At Your Request: DentPal may disclose Personal Information to third parties at your request, direction, or authorization. For example, if you direct DentPal to disclose your Personal Information to a third-party entity, whether and DentPal business partner or other third party to use the third party's service, we will share your information with the third party.

      2. Internal Sharing: DentPal may disclose Personal Information to its affiliates (including parents, entities under common ownership, and subsidiaries, such as DentPal, LLC), and other related companies without authorization.

      3. With Our Vendors: DentPal may disclose Personal Information to Vendors for the purposes of operating our business, delivering, improving, and customizing our products or services, sending marketing and communications related to our business, payment processing, and for other legitimate purposes permitted by applicable law.

      4. With Our Customers: DentPal may disclose Personal Information, including Sensitive Personal Information, to its Customers consistent with the Customer Agreements. “Sensitive Personal Information" refers to Personal Information regarding more sensitive areas, such as government ID and certain other financial information, gender, marriage status, race/ethnicity, or veteran or disability status.

      5. Compliance with Law: To the extent permitted by law, DentPal will disclose Personal Information to government authorities or third parties pursuant to a legal request, subpoena, or other legal process. DentPal may also use or disclose your Personal Information as permitted by law to perform charge verifications, apply, or enforce the Service's Terms of Service, or protect DentPal's rights, interests, or property as well as those of DentPal affiliates, customers, or Service users.

      6. Business Transaction: If DentPal sells all or part of its business or makes a sale or transfer of assets or is otherwise involved in a merger or business transfer, DentPal may transfer your Personal Information to a third party as part of that transaction.

    2. We disclose the following categories of Personal Information for commercial purposes: identifiers, commercial information, internet activity, and geolocation data.

    3. We share information outside of DentPal in the following circumstances:

      1. With Vendors that provide services to us, such as to provide analytics, manage our content, administer ads, provide insights to us related to marketing needs, for market research purposes, and to analyze our marketing efforts.

      2. With third parties that provide use audience matching services.

      3. With our related entities and/or affiliates for business purposes including, but not limited to, customer support, marketing, technical and business operations. We also may share information with affiliates for commercial purposes.

      4. When you make your information public or otherwise accessible to other users through the Sites, such as information that you post related to reviews. Please think carefully before posting such information as you are solely responsible for the content you post and the potential use of such information by others. Once you have posted information, you may not be able to edit or delete such information.

      5. With our Customers and Vendors, when you engage in our surveys as an authorized user, through the onboarding process, through surveys collecting feedback on how we are doing, surveys administered post interaction with us related to support or training, and other surveys, including focus groups and usability design activities such as click tests, card sorts, and other surveys and tests you participate in. We typically notify you in advance that we will share your information with our customers if you complete a survey.

    4. We also share information with other entities in the following situations:

      1. Where you have given us your consent to share or use information about you;

      2. When we believe that we need to share information about you to provide a service that you have requested from us or from others;

      3. Where we are required by law or other legal process to disclose information, and where required, in response to a lawful request by public authorities, including meeting national security or law enforcement requirements;

      4. Where we believe that it is necessary to avoid liability or violations of the law;

      5. To protect the rights, property, life, health, security, and safety of us, the Sites, our Services or anyone else;

      6. To an actual or potential buyer (and its agents and advisers) in connection with any actual or proposed purchase, merger, or acquisition of all or any part of our business.

      7. At your request or direction, such as when you choose to share information with a social network about your activities on the Sites, Portals or with our Services; or

      8. To any other person with notice to you and your consent to the disclosure.

      Notwithstanding the above, we may share information that does not identify you and could not reasonably be used to identify you (including information that has been aggregated, anonymized, or de-identified) except as prohibited by applicable law.

      With respect to deidentified patient information, we disclose such deidentified information to third parties only when permissible pursuant to our Customer Agreements and in accordance with HIPAA requirements or other applicable law.  We employ the safe harbor method or the expert determination method, as enumerated under HIPAA.  Those third parties to whom the deidentified data is disclosed are third party service providers/vendors with whom we have relationships and/or academic researchers and/or institutions that are contributing to healthcare.

  9. Retention and Protection of Data.

    1. While we maintain your information, we protect it using administrative, physical, and technical security safeguards designed to protect your information from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. When we collect certain sensitive information, we encrypt the transmission of that information using secure socket layer technology (SSL). Despite these measures, we cannot guarantee the security of the information we maintain about you. We cannot and do not guarantee absolute security in all circumstances and do not take responsibility for your systems, the Internet itself or third-party actions.

    2. We retain information for different periods of time depending on the purposes for which we collect and use it, as described in this Policy. We will retain your Personal Information for the period necessary to fulfill the purposes outlined in this Policy unless a longer retention period is required or permitted by law. Also, there may be technical or other operational reasons where we are unable to delete or de-identify your information. Where this is the case, we will take reasonable measures to prevent further processing of your information.

    3. DentPal will retain your Personal Information as needed to fulfill the purposes for which it was collected. DentPal will retain and use your Personal Information as necessary to comply with DentPal's business requirements, legal obligations, resolve disputes, protect our assets, and enforce our agreements. Additional information for California residents about our data retention practices is available in our Privacy Notice for California Residents.

  10. Advertising and Third-Party Data Collection. DentPal may enter into relationships with third-party advertising companies to drive traffic to and serve ads on our Site. These third-party companies may also collect information through Data Collection Technologies described in Section 11 to measure the effectiveness of their ads and to personalize advertising content.

  11. Cookies and Automated Data Collection Technologies.

    1. We and our Vendors may use cookies, Web beacons, log files, and other technologies (collectively, "Data Collection Technologies") to help us provide, customize, and improve the Sites, Portals and Services, your online experience, and our customer services. The Data Collection Technologies we use on our Sites or with our Services include:

      1. Web Beacons: A Web Beacon is a Web page element (such as a clear gif, pixel tag or single-pixel gif) that may be embedded into our Sites or e-mail communications, and which may employ cookie technology to enable DentPal to record clickstream data.

      2. Cookies: Cookies are small text files placed on your device to store data that can be recalled by a Web server in the domain that placed the cookie. Cookies enable DentPal to collect clickstream data, including traffic on the Sites. You may set your browser to reject certain cookies or to notify you when you are sent a cookie. Rejecting cookies may limit functionality of the Sites. Third parties also provide software that allows you to visit the Sites without providing certain types of this information. Our Sites may use the following types of cookies:

        1. Essential/Strictly Necessary Cookies: These cookies are necessary for the Sites to function and cannot be switched off in our systems. They are usually only set in response to actions made by you which amount to a request for services, such as setting your privacy preferences, logging in or filling in forms. You can set your browser to block or alert you about these cookies, but some parts of the Sites will not then work.

        2. Analytics/Performance Cookies: These cookies allow us to count visits and traffic sources, so we can measure and improve the performance of our Sites. They help us know which pages are the most and least popular and see how visitors move around the Sites.

        3. Targeting/Advertising Cookies: These types of cookies may be set by our advertising partners at Sites at which a cookie banner is displayed. Cookies also help us deliver advertisements, some of which may be tailored to your behaviors on the Sites, Portals and Services. We engage third parties to help us deliver these advertisements, and these third parties may collect your information over time and across our Sites (and third party sites) and Services in order to associate different devices you use and further gain insights into the goods and services that may interest you. These cookies may be used by those advertising partners to build a profile of your interests and to show you relevant adverts on other websites. You may disallow these targeting/advertising cookies using the cookie banner. California residents may also opt-out of certain sharing of information through these cookies including by visiting the "Your Privacy Choices" section of our Sites and following the instructions there. If you do not allow these cookies, you will experience less targeted advertising.

      To exercise your options with respect to cookies, please select “Cookie Preferences” on the banner that is visible at the bottom of our Sites, or click link on the bottom of www.dentpal.com labeled, “Cookie Preferences”.

      1. Analytics Services: We may use third-party Web analytics services (such as those of Google Analytics) and other technologies on our Sites to: collect and analyze usage information through cookies and similar tools; engage in activities such as auditing, research, or reporting; and provide certain features to you. To prevent Google Analytics from using your information for analytics, you may install the Google Analytics Opt-out Browser Add-on.
        DentPal's use and transfer of information received from Google APIs to any other app will adhere to Google API Services User Data Policy, including the Limited Use requirements.

      2. Notice Concerning Do Not Track: Do Not Track ("DNT") is a privacy preference that users can set in certain web browsers. We are committed to providing you with meaningful choices about the information collected on our Sites for third-party purposes, and that is why we provide the variety of opt-out mechanisms listed above However, we do not currently use technology that specifically recognizes DNT signals from your Web browser. You can learn more about DNT here.

  12. Social Media and Other Integrations. Some of our Sites, Portals and Services may have social media and technology integrations that are operated or controlled by separate entities. We also may collect information from third party social media and marketing companies to enhance our data sets. Some examples include:

    1. Links. Our Sites, Portals and Services include links that hyperlink to websites, platforms, and other services not operated or controlled by us.

    2. Liking, Sharing, and Logging-In. We may embed a pixel or SDK on our Sites that allows you to “like” or “share” content on, or log in to, your account through social media. If you choose to engage with such integration, we may receive information from the social network that you have authorized to share with us. Please note that the social network may independently collect information about you through the integration.

    3. Brand Pages and Chatbots. We may offer our content through social media. Any information you provide to us when you engage with our social media content is treated in accordance with this Policy. Also, if you publicly reference our Sites or Services on social media (e.g., by using a hashtag associated with DentPal in a tweet or post), we may use your reference on or in connection with our Sites, Portals and Services.

    4. Platform Linking. Our Sites, Portals and Services may offer you the ability to link to another service or partner to retrieve certain data about your account on that service. For example, if you link your account to another platform, the linking may allow us to obtain information such as your username and email address. For more information about how these platforms handle information about you, please refer to their respective privacy policies and terms of use.

    Please note that when you interact with other entities, including when you leave our Sites, Portals and Services, those entities may independently collect information about you and solicit information from you. The information collected and stored by those entities remains subject to their own policies and practices, including what information they share with us, your rights and choices on their services and devices, and whether they store information in the U.S. or elsewhere. We encourage you to familiarize yourself with and consult their privacy policies and terms of use.

  13. State Consumer Privacy Rights.

    1. Rights for Residents of Applicable States. If you are a resident of a state with applicable consumer privacy laws, you may have the following rights:

      1. To confirm whether we process your Personal Information.

      2. To access your Personal Information.

      3. To correct inaccuracies in your Personal Information.

      4. To delete your Personal Information that we have obtained.

      5. To receive a copy of your Personal Information in a portable and readily usable format.

      6. To opt out of the sale or sharing of your Personal Information.

      7. To opt out of the processing of your Personal Information for purposes of (i) targeted advertising or (ii) automated decision-making or profiling in furtherance of decisions that produce a legal or similarly significant effect on you.

    If you live in a state that requires specific consent prior to processing your Sensitive Personal Information for certain purposes, we will obtain such and you can withdraw your consent at any time.

    Residents of applicable states may exercise the above rights by submitting a request at info@dentpal.com.

    We may ask you to provide us with information necessary to reasonably verify your identity before responding to your request. We will consider all requests and provide our response within the time period required by applicable law. Please note, however, that certain information may be exempt from such requests. If we deny your request in whole or in part, you may have the right to appeal the decision. In such circumstances, we will provide you with information regarding the appeals process.

    Response Timing and Format

    We endeavor to respond to a consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.

  14. California Resident Privacy Notice. This Privacy Notice for California Residents (this "Notice") supplements the information contained in this Policy and applies to all visitors to our Sites, users and others who reside in the State of California ("you" or as the context requires "your"). We adopt this notice to comply with the California Consumer Privacy Act of 2018 as amended by the California Privacy Rights Act of 2020 ("CCPA/CPRA"), and any terms defined in the CCPA/CPRA have the same meaning when used in this Notice.

    1. Collection of CCPA/CPRA Personal Information. Through a user's interactions with our Services, DentPal collects information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household ("CCPA/CPRA Personal Information").

      CCPA/CPRA Personal Information does not include:

      1. Publicly available information or lawfully obtained, truthful information that is a matter of public concern;

      2. De-identified or aggregated consumer information; or

      3. Certain information excluded from the CCPA/CPRA's scope, such as PHI, health or medical information covered by HIPAA and the California Confidentiality of Medical Information Act ("CMIA") or clinical trial data

    CCPA/CPRA Sensitive Personal Information from Online Sources

    DentPal may collect Sensitive Personal Information from certain online sources, including password information in the course of users accessing our registration system, and driver's license and state identification numbers in some instances.

    1. CCPA/CPRA Consumer Rights. California residents may have certain consumer rights. These rights may include:

      1. The right to know what CCPA/CPRA Personal Information we collect, including (1) the right to request information regarding the categories of CCPA/CPRA Personal Information we collect along with other information such as the categories of sources from which the information is collected and third parties with whom it is shared and (2) the right to request a copy of the specific pieces of CCPA/CPRA Personal Information we collect (sometimes referred to as the right to access Personal Information)

      2. The right to delete CCPA/CPRA Personal Information that we collect from you, subject to certain exceptions;

      DentPal will not discriminate against you for exercising any of the abovementioned rights, for example, by charging a different price or denying goods or services. However, DentPal may charge a different price or rate or provide a different level or quality of goods or services when that difference is reasonably related to the value provided to us by the data.

      You may also limit the use and disclosure of your CCPA/CPRA Personal Information by either unsubscribing from marketing communications or contacting DentPal at the address listed under Section 17 titled "Contact Information." Please note that some information may remain in DentPal's records even after you request deletion of your CCPA/CPRA Personal Information, to the extent required by applicable laws. Additionally, there may be limits to the amount of information DentPal can practically provide. For example, we may limit access to CCPA/CPRA Personal Information where the burden or expense of providing access would be disproportionate to the risks to an individual's privacy or where doing so would violate others' rights.

DentPal may continue using Sensitive Personal Information for certain purposes expressly permitted by the CCPA/CPRA.

    California residents may exercise the above rights by submitting a request at info@dentpal.com.

    Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child.

    We may ask you to provide us with information necessary to reasonably verify your identity before responding to your request. We may require you to use your email address in order to perform such verification. We will consider all requests and provide our response within the time period required by applicable law. Please note, however, that certain information may be exempt from such requests. The rights described herein are not absolute and we reserve all our rights available to us at law in this regard. Additionally, if we retain your CCPA/CPRA Personal Information only in de-identified form, we will not attempt to re-identify your data in response to a Consumer Rights request.

    If we deny your request in whole or in part, you may have the right to appeal the decision. In such circumstances, we will provide you with information regarding the appeals process.

    You may only make a consumer request for access or data portability twice within a 12-month period. We will not discriminate against you for exercising any of your rights.

    1. Other California Privacy Rights. California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of our Sites that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes in particular: residents of California may request (i) a list of the categories of Personal Information disclosed by us to third parties during the immediately preceding calendar year for those third parties’ own direct marketing purposes; and (ii) a list of the categories of third parties to whom we disclosed such information.     2. DentPal as a Service Provider. If you wish to make your request directly to us, please provide the name of our Customer on whose behalf we processed your Personal Information. We will refer your request to that Customer and will support them to the extent required by California privacy law in responding to your request.

  1. Children’s Privacy.

    1. Our Sites are not directed toward individuals under the age of 18. We do not promote our Sites to individuals under 18, and we do not knowingly collect any Personal Information through our Sites from individuals under 18. Access to our Services is separately governed by the Services’ posted Terms of Service.

    2. Our Sites, Services, and Portal may be subject to the Children’s Online Privacy Protection Act of 1998 (COPPA). Although not designed for children, our Sites, Services and Portal may contain content relevant to children under the age of 13.
